Terms & Conditions of Carriage

Effective Date: April 1, 2026

These Terms govern your use of Binani Air flights, website, and services. By booking a ticket, you agree to these terms.

1. Definitions & Interpretation

"Binani Air", "we", "our" refers to Binani Air airline operating under certificate [BN-2024-001]. "Passenger" means any person, except crew, carried or to be carried in an aircraft. "Flight" includes all scheduled and charter services operated by Binani Air.

2. Booking, Ticketing & Fares

All fares are quoted in USD/EUR/local currency and include applicable taxes, fees, and carrier charges unless stated otherwise. Tickets are non-transferable but may be refunded or changed according to the fare type (Basic, Flex, Business).

  • Basic Economy: No changes, non-refundable (taxes refundable).
  • Flex Economy: Free changes up to 2 hours before departure.
  • Business Class: Fully refundable, free rebooking, extra baggage.
Name correction policy: Minor spelling corrections (up to 3 characters) are free of charge 48h prior to departure. Name changes are not permitted.

3. Check-in & Boarding

Online check-in opens 48 hours before departure and closes 60 minutes before departure. Airport check-in closes 45 minutes for domestic and 60 minutes for international flights. Boarding gates close 20 minutes before scheduled departure. Late passengers will be rebooked at their own expense.

4. Baggage Allowance

Carry-on: 1 piece up to 7kg (55x35x25 cm). Checked baggage depends on route/fare:

Excess baggage fees apply at 15 USD /kg. Prohibited items include lithium batteries >160Wh, compressed gases, and explosives.

5. Flight Changes, Cancellations & Refunds

If Binani Air cancels a flight for reasons within our control (not force majeure), you may choose: (a) full refund, (b) rebooking on next available flight, or (c) credit voucher + 20% bonus. For weather, ATC strikes, or geopolitical events (force majeure), we will rebook but no cash refund is due.

Voluntary cancellation by passenger: refunds as per fare rules. "No-show" voids the ticket.

6. Passenger Responsibilities & Conduct

You must present valid identification, visas, health certificates, and other travel documents. Binani Air is not liable for denied boarding due to insufficient documents. Unruly behavior (including aggression, non-compliance with crew instructions, or smoking) will result in removal from the flight, a fine, and a permanent ban from future flights.

7. Denied Boarding & Overbooking

In the event of overbooking, we will first solicit volunteers for compensation (cash or vouchers).

8. Limitation of Liability

In the case of death or bodily injury of passenger, if as required by any law, regulation, or regulatory body, to make advance payments without delay to a natural person or persons who are entitled to claim compensation in order to meet the immediate economic needs of such persons, such advance payments shall not constitute a recognition of liability and may be offset against any amounts subsequently paid as damages. We shall not be liable where it can be shown that such damage was not due to our negligence or other wrongful act or omission.

Important: Claims for damaged baggage must be filed within 7 days of receipt; delayed baggage claims within 21 days. No liability for fragile/perishable items in checked bags.

9. Special Assistance & Medical Conditions

Passengers requiring special assistance (wheelchair, oxygen, visual/hearing impairment) must notify Binani Air at least 48 hours before departure. Pregnant passengers beyond 36 weeks require a medical certificate dated within 7 days of travel. We reserve the right to refuse travel if a passenger poses a safety risk.

10. Use of Website & Mobile App

Our website (binaniair.com) uses cookies, collects personal data for booking and security, and may link to third-party travel insurance providers. You agree not to scrape, misuse, or disrupt our systems. All content, logos, and trademarks are owned by Binani Air.

11. Data Protection & Privacy

We process your personal data (name, passport, payment info, health data where necessary) in accordance with GDPR/CCPA as applicable. You have the right to access, rectify, and delete your data. Our full privacy policy is available separately.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of [Jurisdiction – e.g., Ireland / Singapore / UAE], without regard to conflict of laws. Any dispute relating to carriage shall be submitted to the courts of [your hub city]. For EU passengers, alternative dispute resolution through the National Enforcement Body is available.

13. Modifications to Terms

Binani Air may update these Terms at any time. Material changes will be notified via email or on our website at least 14 days in advance. Continued use of our services constitutes acceptance.

Acknowledgment: By traveling with Binani Air, you confirm that you have read, understood, and agreed to these Terms and Conditions. These terms override any conflicting statements made by third-party travel agents.
